European Accessibility Act in Poland: what small online businesses need to know
How the EAA applies in Poland: the national law, who enforces it, the fines, the microenterprise exemption and the duties that catch small businesses out.
Last checked: 3 November 2026. Guidance, not legal advice.
The law
Ustawa o zapewnianiu spełniania wymagań dostępności niektórych produktów i usług przez podmioty gospodarcze (Dz.U. 2024 poz. 731), in force since 28 June 2025.
Who enforces it
PFRON leads market surveillance; for e-commerce the competent authority is the minister responsible for digital affairs. Anyone can report a non-compliant service to PFRON.
Fines
- Up to ten times the average monthly wage of the previous year, capped at 10% of the business's turnover (art. 73).
Are small businesses exempt?
Services provided by microenterprises are fully exempt (art. 4 pt 1). The usual Polish definition is fewer than 10 employees and annual turnover or balance sheet total of at most the złoty equivalent of €2 million.
What to watch for
- Publish the accessibility information in your terms of service (regulamin) or another accessible form, and keep it up to date (art. 32).
- Customers can complain directly to you: you must answer within 30 days (60 in complex cases) — if you miss the deadline the complaint counts as accepted (art. 35–37).
- Contracts signed before 28 June 2025 may continue unchanged until 28 June 2030 at the latest.
Not yet confirmed
We only state what we could confirm. These points still need checking against the official text:
- The act does not visibly cross-reference the general microenterprise definition; we apply it as standard Polish law.
- The current złoty value of the fine cap.
