European Accessibility Act in the Netherlands: what small online businesses need to know
How the EAA applies in the Netherlands: the national law, who enforces it, the fines, the microenterprise exemption and the duties that catch small businesses out.
Last checked: 3 November 2026. Guidance, not legal advice.
The law
Implementatiewet toegankelijkheidsvoorschriften producten en diensten (Stb. 2024, 87), in force since 28 June 2025.
Who enforces it
The ACM (Autoriteit Consument & Markt) for webshops and other e-commerce services; other regulators cover banking (AFM), e-books and media (Commissariaat voor de Media) and passenger transport (ILT).
Fines
- The ACM can fine up to €900,000 or 1% of turnover, whichever is higher (Whc art. 2.15), and impose penalty payments.
- Other regulators can fine up to the fifth category, €110,000 from 1 January 2026.
Are small businesses exempt?
Exempt: fewer than 10 employees and annual turnover or balance sheet total of at most €2 million (Civil Code art. 6:230fc).
What to watch for
- Webshops get no general grace period to 2030 — the transition rules exclude e-commerce services.
- If you rely on the disproportionate-burden exception, you must carry out and document an assessment.
- Anyone can report an inaccessible website or app to ACM ConsuWijzer; the ACM says it focuses on critical problems first.
Not yet confirmed
We only state what we could confirm. These points still need checking against the official text:
- The exact wording of the information duty (Civil Code art. 6:230fb).
- Whether a further transitional rule (Overgangswet BW art. 190aa) gives webshops any grace period.
